Man charged in rape of a 16-year-old girl

ENID, Okla. — A 39-year-old Enid man has been charged with one felony count of first-degree rape for allegedly raping a 16-year-old girl.

Timothy Wayne Smith, of Enid, is accused of raping the girl while visiting at a county home over the Christmas holiday.

According to an affidavit filed in the case, the girl went into the room where Smith was staying on Dec. 26. The girl told authorities Smith started “touching me wrong,” and that he had sex with her in spite of her repeatedly telling him to stop.

According to the affidavit, police and deputies were called to the home where Smith was visiting Jan. 3, after Smith allegedly admitted the offense to the girl’s mother and to another man who was staying at the home.

When police and deputies contacted Smith at the home, he “kept making a spontaneous utterance of ‘you know what I did, just take me to jail’ and ‘she told you what I did, take me to jail,’” according to the affidavit.

Smith subsequently was arrested and taken to Garfield County Detention Facility, where he remained in custody Thursday. Smith’s bond was set at $250,000 during a video arraignment Thursday before Special District Judge Brian Lovell.

Smith is next scheduled for a bond appearance Feb. 4.

The charge of first-degree rape is punishable by imprisonment for no less than five years.
