Enid man facing drug charges in Kay County

PONCA CITY -- An Enid man is scheduled to appear Dec. 2 in Kay County District Court on several charges related to his arrest Sept. 26.

Kyle Delmar Backus, 35, is charged with felony complaints of endeavoring to manufacture methamphetamine, possession of a controlled substance, assault and battery on an officer, misdemeanor charges of unlawful possession of drug paraphernalia and resisting an officer and a traffic citation for no insurance.

According to court records, Ryan Trant, a loss prevention officer employed by Wal-Mart in Ponca City, notified the Ponca City Police Department Sept. 26 he observed Backus purchasing items often used for manufacturing methamphetamine.

When officer Anthony Rogers arrived, Trant identified the white Toyota Camry Backus was driving, according to the affidavit. When Backus left the parking lot, Rogers initiated a traffic stop. According to the affidavit, Rogers said Backus was shaking and told him he did not have a driver's license. He also handed Rogers an expired insurance slip, according to the affidavit.

According to court records, Rogers asked to see the items Backus purchased at Wal-Mart. The items purchased were a lantern, Coleman propane fuel, hydrogen peroxide, acetone solvent, coffee filters, latex gloves, three and one-half-quart cooking pot and a box of 1,000 matches. A search of the car revealed a bottle of iodine and a plastic bag containing 1.3 ounces of marijuana and rolling papers, according to the affidavit.

Charges continued to mount for Backus on Oct. 28 when his bail bondsman, Sarah Gosting, told Kay County Sheriff's Department she was revoking Backus' bond and turning him over to the department.

According to court records, Backus attempted to leave the Kay County Courthouse lobby and Gosting tried to stop him. According the affidavit, Deputy Shannon Wathor also tried to restrain Backus, and he hit the deputy twice in the chest with his elbow.
